This purchase agreement, made and entered into between WILDWOOD KENNEL, hereinafter referred to as "Seller" and _______________________________________, hereinafter referred to as "Buyer", for the purpose of setting forth the terms and conditions of the purchase by Buyer of a purebred       male     female    Golden Retriever from the litter
whelped on___________________________________out of

(hereinafter referred to as Puppy/Dog).  Buyer will pay for the dog in accordance with the terms of this contract.

Ownership of the dog will be transferred to the buyer for the sale price of $__1,200__.
To be paid as follows:
$__$200_______paid on ________________as a non-refundable deposit, no exceptions.   If no puppy is available, deposit will be applied to the next available litter.
The balance of $_1,000___to be paid on or before six (6) weeks of age.  If shipping, balance to be paid in full three (3) weeks prior to puppy being shipped..  
If the balance is not paid by _6 weeks of age__________, this Agreement shall be canceled and the buyer forfeit's the deposit given hereunder.

This dog is being sold as a companion.  The dog is being sold with Limited American Kennel Club (AKC) registration and NO breeding rights.  No litters produced by the breeding of this dog will be accepted by the American Kennel club for registration while on Limited Registration.  Limited registration precludes Buyer from showing dog in conformation shows.  Said registration entitles Buyer to register dog with AKC and attend sanctioned obedience and performance trials.  Buyer agrees that this puppy/dog will NOT be registered with any registry other than the American Kennel Club (AKC).   Registration in ANY other registry will result in puppy/dogs immediate surrender to Seller.  It shall be understood that at the time of sale this dog is NOT considered to be of show or breeding quality, but is representative of its breed and is structurally and temperamentally suited as a companion.  The Seller warrantees that the dog is free of hereditary defects to the best of his/her knowledge at the time Buyer assumes ownership.

If the dog is unsatisfactory and is to be returned to Seller, it must be done within the time limit of one (1) week from the date dog was delivered to buyer.  The dog is to be returned to Seller at Buyer's expense and must be in the same physical condition as when it left the Seller in order for a refund of any purchase or deposit moneys to be returned.  One half of the sales price is to be forfeited if the dog is returned for any other reason than failure to pass veterinary examination.

Seller warrantees that the dog is in good health and has received appropriate medical inoculations and care, including parvo inoculations.  Seller will provide Buyer with a medical record detailing treatment dog has received under Seller's care.  Buyer agrees that he/she is not acting as an agent in the purchase of this dog and that Buyer will not sell dog or it's progeny to any agent or pet store.

Buyer agrees to register puppy using the prefix "Wildwood's" at the beginning of the puppy's AKC registered name.  This will be written on the AKC Registration application by Seller.  Failure to do so voids any health guarantee.

The Buyer and Seller agree to a two year warrant against crippling hereditary genetic hip dysplasia.  The puppy's hips must be x-rayed by a licensed veterinarian within 4 weeks of the two year birth date, no later than 25 months of age.  The x-rays must be submitted to the Orthopedic Foundation for Animals (OFA) for evaluation PLUS a copy of the x-ray must also be sent to Wildwood Golden Retrievers.  If the puppy is found to have Severe Crippling Genetic Hip Dysplasia the buyer is entitled to a replacement puppy from the next available litter of equal value.  The buyer must present proof in writing, including the x-rays, all showing crippling hip dysplasia and return all AKC papers signed over to the seller in order to receive a replacement puppy.   Because this puppy is placed as a companion, and not as a breeding/show dog, no guarantees are made for future "clearances" (see below), only that the puppy will be able to function as a pet/companion.   All shipping costs for the replacement puppy is the sole responsibility of the buyer.  Buyer is not required to return the affected puppy.  Dysplasia caused by obesity, dietary deficiency, over-exertion and other preventable reasons is NOT WARRANTEED.  Replacements on any puppy is limited to ONE replacement per Original sales agreement, of the breeder's choice and from the soonest available litter.  THIS WARRANTEE APPLIES TO THE ORIGINAL BUYER ONLY AND IS NONTRANSFERABLE. 

Buyer agrees to maintain preventative care of Puppy in regards to hip and elbow dysplasia such as proper nutrition, proper exercise, and preventing stress injuries (I.e. not allowing puppy to jump from heights taller than itself at the shoulder, no forced exercise such as running) until at least 18 months of age.

Buyer agrees that the dog will reside at the home of the Buyer, have access to a fenced yard, adequate shelter, not be chained or tethered and will be provided with a proper diet and grooming.  puppy will NOT ride uncrated in the open bed of any truck.  Puppy shall receive proper veterinary care throughout its lifetime.  It is strongly recommended that Buyer avoid any unnecessary vaccinations.  Puppy shall receive proper nutrition and care shall be taken to maintain its proper weight.  The puppy SHALL be switched to adult formula dog food by the time it is 16 weeks old.  Failure to switch to adult food by 16 weeks or allowing this puppy to become overweight shall void any replacement due to hip or elbow dysplasia.

If delivery is requested by Buyer, it shall be by air-freight, (unless other arrangements are made) C.O.D. to a designated location.  Buyer is solely responsible for costs of crate, insurance during shipment, health certificate and cost of freight charges. Cost of crate and Health Certificate to be paid in full prior to shipping.

RELEASE OF LIMITED REGISTRATION

Buyer shall be allowed the option of changing from "pet quality" (limited registration) to "breeding/show quality" (full registration) after obtaining all necessary health clearances as set forth by the Golden Retriever Club of America (GRCA) at the time of the request.
Current certifications required ( subject to change):
    1) hips and elbows - verified by the Orthopedic Foundation for Animals (OFA)
    2) eyes - verified by a board certified opthomologist
    3) heart - verified by a board certified cardiologist
    4) A second level title (ie. - CDX, TDX, WCX, SH, etc)

Seller shall, upon receipt of all necessary clearances, titles and payment of $__800__
(difference between companion quality and show/breeding quality) release the original limited registration to a full registration.  Buyer has NO breeding rights while puppy/dog is on Limited Registration.  If this puppy/dog is bred at any time (either accidentally or intentionally) while on Limited Registration, Buyer agrees to pay Seller $800.00 per puppy produced by said breedings or value of said puppies, whichever is greater.  A second breeding of puppy/dog will result in the immediate surrender of puppy/dog to Seller.  This clause will remain in effect with original buyer even if ownership is transferred, unless released in writing by Seller.  If Puppy is spayed/neutered, this clause becomes null and void.

Every reasonable precaution has been made to preserve the "True Golden Retriever Temperament".  However, the Seller strongly recommends that Buyer attend obedience classes with Puppy and provide proper socialization opportunities for Puppy.  Seller shall not be held responsible for acts of Puppy which are due to Buyers negligence.  Buyer agrees to accept full responsibility for Puppy's actions and hereby releases Seller from any and all claims and damages which may arise directly or indirectly from Puppy's actions.

No guarantees or warranties, expressed or implied, are given by Wildwood Golden Retrievers or Cheryl Metteer, the Seller, except those stated herein.

Seller warrants and agrees that she is the lawful owner of this puppy and is alone responsible for entering into this contract with the Buyer.  The co-breeder of this litter is in no way responsible for the commitments set forth herein.

Should the Seller need to seek legal action against the Buyer for violations of this agreement, and prevails, Buyer will assume any and all attorney costs and court fees related to the action.

And finally...Buyer agrees that he/she understands this contract fully, and that this contract is under the jurisdiction of the State of Oregon, in the county of Lane.  It is agreed that the place of venue shall be in Lane County, Oregon.
